Average Tribunal Awards

Average Tribunal Awards:
As you know, compensatory awards in unfair dismissal claims are currently capped at £72,300 and awards in discrimination and whistleblowing claims are uncapped. What do successful claimants in the Employment Tribunal really get though?

 

The Court and Tribunal website states that for the financial year 2010 to 11, average awards made in the Employment Tribunal were:

  • Age Discrimination: £12,697
  • Disability Discrimination: £6,142
  • Race Discrimination: £6,277
  • Religious Belief Discrimination: £6,892
  • Sex Discrimination:£6,078
  • Sexual Orientation Discrimination: £5,500
  • Unfair Dismissal: £4,591

 

Average awards overall are £5,000. The trouble is that most claimants of course claim much higher damages and very often even if an employer wants to settle a claim, it is not possible. There are of course some claimants who recover much more than the average figures given here. However these average figures are a useful insight into what the kind of awards Tribunals often give.
